Services Provided
Company offers information and a means to obtain transportation services offered by third-party transportation providers, drivers, or vehicle operators (the "Service Provider"), which may be requested through the use of an application supplied by Company, downloaded and installed by you on your smartphone (the "Application"), or through any other channel made available by Company for real-time ride tracking and booking purposes.
All services provided by Company to you by means of your use of the Application are hereafter referred to as the "Service."
Contract Between You and Company
User(s) means any individual or business entity/organization that legally operates in India or in other countries, uses and has the right to use the Services provided by Company. By using the Application or the Service, you enter into a contract with Company (the "Contract").
In order to use the Application or Service, you first need to sign up with Company. When signing up, you are obligated to provide Company with your personal information, mobile telephone number and credit card data. Upon successful completion of your sign-up with Company, Company will provide you with a personal account accessible with a password of your choice.
If you reside in a jurisdiction that restricts the use of the Service or Application because of age, or restricts the ability to enter into contracts due to age, you must abide by such age limits and you must not use the Service and Application. You represent that if you are an individual, you are of legal age to enter into a binding contract, or that if you are registering on behalf of a legal entity, you are authorized to enter into, and bind the entity to, these User Terms.
Company advises its users that while accessing the website, they must follow and abide by applicable laws. Company is not responsible for the possible consequences caused by your behavior during the use of services provided by Company. Company may, in its sole discretion, refuse service to anyone at any time.
This agreement applies to user(s) who are visitors, registered free users, or paid user(s) who access the application and website for any purpose. It also applies to any legal entity represented by you under actual or apparent authority. User(s) may use this site solely for their own personal or internal purposes.
How to Use the Application and Services Provided
The Application allows you to send a request for transportation service to a Service Provider. The GPS receiver installed on your mobile device detects your location and sends location information to the relevant Service Provider.
The Service Provider has sole and complete discretion to accept or reject each request for transportation service and to use the Application to receive leads generated through the Application.
If the Service Provider accepts a request, the Application notifies you and provides information regarding the Service Provider, including name, vehicle registration number, and customer service rating, and enables telephone contact with the Service Provider. The Application also allows you to view the Service Provider's progress toward the pickup point in real time.
Company shall use reasonable efforts to connect you with a Service Provider in order to obtain transportation services, subject to the availability of Service Providers around your location at the time of your request.
For the avoidance of doubt, Company itself does not provide transportation services and is not a transportation carrier. Company only acts as an intermediary between you and the Service Provider. The transportation service is subject to the agreement entered into between you and the Service Provider. Company is never a party to such agreement.
Manner of Use of Application and Services by You
You warrant that the information you provide to Company is accurate and complete. Company is entitled at all times to verify the information you have provided and to refuse the Service or use of the Application without providing reasons.
You may only access the Service using authorized means. It is your responsibility to ensure you download the correct Application for your device. Company is not liable if you do not have a compatible mobile device or if you download the wrong version of the Application. Company reserves the right to terminate the Service and the use of the Application if you are using the Service or Application with an incompatible or unauthorized device.
By using the Application or the Service, you agree that:
- You will only use the Service or download the Application for your sole, personal use and will not resell it to a third party.
- You will not authorize others to use your account.
- You will not assign or otherwise transfer your account to any other person or legal entity.
- You will not use an account subject to rights of another person without appropriate authorization.
- You will not use the Service or Application for unlawful or fraudulent purposes.
- You will not use the Service or Application to cause nuisance, annoyance, or inconvenience.
- You will not impair the proper operation of the network.
- You will not try to harm the Service or Application in any way whatsoever.
- You will not copy or distribute the Application or other Company content without written permission from Company.
- You will keep secure and confidential your account password or any identification that allows access to the Service.
- You will provide proof of identity as reasonably requested by Company.
- You will only use an access point or data account that you are authorized to use.
- You are aware that standard messaging charges will apply when requesting transportation by SMS or through the Application.
- You will not use the Service or Application with an incompatible or unauthorized device.
- You will comply with all applicable laws of your home nation, country, state, and city while using the Application or Service.
Company reserves the right to immediately terminate the Service and use of the Application if you do not comply with any of the above rules.
Payment
You understand that use of the Services may result in charges to you for services you receive ("Charges"). Company will receive and/or enable your payment of applicable Charges for services obtained through your use of the Application.
Charges will be inclusive of applicable taxes where required by law and may include other applicable fees, tolls, and/or surcharges including a booking fee, municipal tolls, airport surcharges, or split payment processing fees. All Charges and payments will be enabled by Company using the preferred payment method in your Account, after which you will receive a receipt by email. If your primary payment method is expired, invalid, or otherwise cannot be charged, Company may use a secondary payment method in your Account, if available.
As between you and Company, Company reserves the right to establish, remove, and/or revise Charges for any or all services obtained through the Services at any time in Company's sole discretion. Company will use reasonable efforts to inform you of Charges that may apply; however, you remain responsible for Charges incurred under your Account regardless of your awareness of such Charges or amounts.
Company may provide promotional offers and discounts that may result in different amounts charged for the same or similar services, and such offers, unless made available to you, have no bearing on Charges applied to you. You may cancel your request for services before the Service Provider arrives, in which case you may be charged a cancellation fee.
This payment structure is intended to fully compensate the Service Provider for services provided. Any statement by Company that tipping is voluntary, not required, and/or included is not intended to suggest Company provides additional amounts to Service Providers beyond the amounts described above. Gratuities are voluntary.
Damages or Cleaning Fees
You are responsible for the cost of repair for damage to, or necessary cleaning of, vehicles and property resulting from use of the Services under your Account in excess of normal wear and tear ("Repair or Cleaning").
If a Service Provider reports a need for Repair or Cleaning and the request is verified by Company in its reasonable discretion, Company reserves the right to facilitate payment for the reasonable cost on behalf of the Service Provider using your payment method in your Account. These amounts are transferred to the applicable Service Provider and are non-refundable.
If a Service Provider reports that you have materially damaged the vehicle, you agree to pay for the reasonable cost of such Repair or Cleaning via your payment method on file with Company.
You agree to cooperate with and assist Company in good faith, and provide information and take actions reasonably requested by Company in connection with complaints or claims made by Service Providers or third parties with respect to goods or services, your use of the Services, or breach of these Terms of Use.
If you have a dispute with one or more Service Providers, you release Company (and its officers, directors, agents, subsidiaries, joint ventures, and employees) from any and all claims, demands, and damages (actual and consequential) arising out of or connected with such disputes.
Cancellation Policy
You may cancel an order within a timeframe specified on the Website. The cancellation window varies by city and may change from time to time. To view the applicable cancellation window, please check the Website.
Not all orders are eligible for cancellation. Cancellation after the specified cancellation window may result in cancellation fees.
Termination
You may terminate this Agreement at any time by discontinuing use of the Services. Company may terminate this Agreement at any time and for any reason, including violation of these Terms of Use, fraudulent or illegal use of the Services, or actions that may cause harm to others or Company.
In the event of termination by Company for violation of these Terms of Use, any remaining balance in your account at the time of violation may be forfeited, and you may be prohibited from using the Services in the future.
Governing Law and Dispute Resolution
These Terms of Use are governed by and construed in accordance with the laws of the State of [Your State], without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms of Use or your access or use of the Services will be subject to the exclusive jurisdiction of the state and federal courts located within the State of [Your State], and you submit to the personal jurisdiction of such courts.
Amendments
